Our client, a national corporation in the transportation industry, was sued by a nearly 20-year employee for wrongful termination and failure to promote based on a disability, and for failure to accommodate a disability. The plaintiff's employment was terminated for on the job misconduct. The plaintiff attributed the misconduct to his disability, arguing our client insufficiently accommodated the disability. CDF successfully obtained summary judgment and the court issued a 20-page decision, agreeing with our client’s defense.
